“If you won’t apologize, you will have to face the trial,” the Supreme Court said pulling up the leader of the Congress for his defamatory comments. “We have held it might be historically right but the fact or the statement has to meet the test of public good. You can’t make collective denunciation,” as per the Bench involving Justices RF Nariman and Dipak Misra.
The Bench said that “opportunity is neither crippled nor curbed. What is curbed is the right to speak freely. What the authors, legislators, commentators or the antagonists say, you should have extraordinary extent to swallow”.
